IN NO EVENT SHALL THE AGGREGATE LIABILITY OF PIZZA FACTORY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) ONE HUNDRED UNITED STATES DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO PIZZA FACTORY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

The limitations of liability set forth above are fundamental elements of the basis of the bargain between Pizza Factory and you. Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so the above limitations may not apply to you in their entirety.

You agree that any legal action or proceeding arising out of or related to these Terms or your use of our Services shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States, and you hereby consent to the personal jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute, claim, or controversy with Pizza Factory informally. You must provide written notice to Pizza Factory describing the nature of the dispute and your desired resolution. Pizza Factory will have thirty (30) days to respond to your notice. 12.3 Class Action Waiver

YOU AND PIZZA FACTORY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Unless both you and Pizza Factory agree otherwise, the arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.

12.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to prevent irreparable harm pending resolution through arbitration. Nothing in this section shall be deemed to waive any party's right to seek such emergency relief.
